GENERAL TERMS AND CONDITIONS ZWEMLES MERELBEKE
1. Applicability
These terms and conditions apply to all swimming lessons, services and agreements between Zwemles Merelbeke (hereinafter: "the Instructor") and the client (hereinafter: "the Participant" or "the Parent/Guardian" or "the Client"). By booking a lesson or paying for a series of lessons, the client declares their agreement with these terms and conditions.
2. Registration and Payment
2.1. A registration is only final upon receipt of payment or a written confirmation by the Instructor.
2.2. Payment for the lessons must be made in advance by bank transfer.
3. Cancellation by the Client (No-show policy)
3.1. Cancellation period: The client can cancel or reschedule a planned lesson free of charge up to 48 hours before the start of the lesson.
3.2. Late cancellation: In the event of cancellation less than 48 hours before the start of the lesson, regardless of the reason, the full lesson fee remains due. No refund will be given in this case and the lesson cannot be made up.
3.3. No-show: If the Participant does not appear for the lesson without prior notice, the lesson is considered to have taken place and will be charged in full.
4. Illness and Force Majeure
4.1. In the event of prolonged illness of the Participant (more than 2 consecutive lessons), a suitable solution (such as transferring the credit) can be sought upon presentation of a medical certificate.
4.2. A single absence due to illness falls under article 3.2, unless the Instructor decides otherwise out of commercial goodwill.
5. Cancellation by the Instructor (Reciprocity)
5.1. If the Instructor must cancel the lesson (due to illness, technical defects at the swimming pool or other force majeure), the Participant will be notified as soon as possible.
5.2. In that case, the Participant is entitled to a make-up lesson or a full refund of the relevant lesson.
6. Safety and Liability
6.1. The Participant (or their guardian) is obliged to report relevant medical information (e.g. epilepsy, asthma, allergies) in writing in advance.
6.3. The Instructor is not responsible for loss, theft or damage to personal belongings in the changing rooms or the swimming pool complex.
6.4. Parents/supervisors remain responsible for children in the changing rooms and up until the moment the lesson effectively starts.
7. Right of Withdrawal
In accordance with Art. VI.53, 12° of the Code of Economic Law, the client does not have a right of withdrawal for leisure services scheduled on a specific date or during a specific period. For all bookings of swimming lessons where a specific date and time are fixed at the time of purchase, the 14-day right of withdrawal therefore does not apply. The booking is final after payment and confirmation.
8. Privacy (GDPR)
The personal data of the Participant is only processed for the administration and planning of the swimming lessons. This data is not shared with third parties.
